AUCD signs Supreme Court Amicus Brief in Endrew v. Douglas County School District

AUCD signed an amicus brief filed by the National Disability Rights Network (NDRN) in the Endrew case, in which the Supreme Court issued a ruling affirming IDEA protections for students with disabilities.

Guidance on Section 504 and Restraint and Seclusion

The U.S. Department of Education released a set of guidance documents that provide information about the legal limitations on the use of restraint and seclusion with regard to students with disabilities. These include a new Parent and Educator Resource Guide to Section 504, a Q & A sheet, and a Dear Colleague Letter issued by the Office for Civil Rights.

Medicaid Home and Community-Based Services Programs: 2011 Data Update

This Kaiser Family Foundation report summarizes the key national trends to emerge from the latest (2011) participant and expenditure data for the three main Medicaid HCBS programs: the mandatory home health services state plan benefit, the optional personal care services state plan benefit, and optional 1915(c) HCBS waivers. It also briefly discusses the provision of Medicaid HCBS through 1115 demonstration waivers and highlights findings from a 2013 survey of Medicaid HCBS participant eligibility, enrollment, and provider reimbursement policies.

Olmstead: Community Integration for Everyone

To commemorate the 12th anniversary of the Olmstead decision, the Department of Justice launched a new section of its ADA website providing information and resources about the decision and its enforcement. Users can visit the site to find briefs filed by the Department, as well as other relevant materials. The website provides easy access to an extensive collection of ADA technical assistance materials and settlement agreements, as well as information about enforcement, mediation, technical assistance and certification activities and links to other sites with ADA information.

Statement of the Department of Justice on Enforcement of the Integration Mandate of Title II of the Americans with Disabilities Act and Olmstead v. L.C.

The Department of Justice released a new technical assistance document describing public entities' obligations and individuals' rights under the integration mandate of title II of the Americans with Disabilities Act (ADA) and the 1999 landmark Supreme Court decision, Olmstead v. L.C. The document also provides questions and answers on a variety of ADA enforcement issues related to Olmstead.
