AUCD Statement on the
U.S. Department of Education Notice of Proposed Rule Making
for the Every Student Succeeds Act (ESSA) of 2015

The passage of the Every Student Succeeds Act in December 2015 was an important step forward for children with disabilities and the opportunities they have for a great education. AUCD is encouraged that the Department of Education has released proposed rules on accountability, state plans, and the transparency of data. We support the Department's efforts to write rules that focus on making data accessible to families and communities, ensuring students with disabilities are included in all school accountability systems, and supporting States and local school districts to create interventions that address the needs of children with disabilities when they are in a consistently underperforming subgroup. We thank the Department for its thoughtful and expedient issuing of these proposed rules and will examine them closely and provide further comment to ensure children with disabilities are well served as ESSA is implemented throughout the country.
