Mediation is a negotiation where the parties come together in an effort to reach an agreement. Some school system attorneys have a practice of agreeing to mediate, and then backing out of the mediation at the last moment based on the IDEA requirement that mediation is voluntary. While the school system's approach to mediation does not violate the IDEA, it essentially forces the parents to pursue a due process hearing.Back to Session: Welcome Reception and Poster Session
