The US Department of Justice (DOJ) issued a letter to Virginia Governor McDonnell regarding findings from their investigation of the Commonwealth of Virginia's compliance with the Americans with Disabilities Act (ADA) and of Central Virginia Training Center. The DOJ found Virginia in violation of the ADA by failing to provide services to individuals with intellectual and developmental disabilities in the most integrated settings appropriate to their needs, resulting in unnecessary and prolonged segregation in institutional facilities. The DOJ report indicated these violations were evidenced by the Commonwealth's failure to develop a sufficient quantity of community-based alternatives to institutions, failure to use available resources for such settings, absence of an inadequate discharge planning process, as well as the absence of services intended to prevent admission of individuals to training centers during periods of crisis.
